§ 1 General

1. These Terms and Conditions are applicable to the supply of products made by the Seller, hereafter referred as Cambree, to the buyer hereafter referred as the customer.

2. A customer in these terms and conditions is a natural person that has the right to close a legal transaction and to whom this document is addressed.

§ 2 Ordering

2.1 Products may be ordered by following the onscreen directions to purchase a Product advertised for sale on the Site. It is possible to check and correct any input errors in the order up until the point at which the customer submits the order by clicking the “Place Order” button.

2.2 After placing an order, the customer will receive a confirmation e-mail from Cambree acknowledging that the order has been received. In this e-mail the customer will be given an order number and a summary of the order. Placing an order with Cambree and receiving a confirmation e-mail does not mean that the order has been accepted. Placing an order constitutes an offer to Cambree to buy a Product. All orders must be accepted by Cambree, such acceptance will be confirmed to the customer by sending out the ordered items. The contract between Cambree and the customer will only be formed when the order has been sent out.

2.3 Cambree may choose not to accept an order for any reason and will not be liable to the customer or to anyone else in those circumstances.

§ 3 Right of Withdrawal

The customer has the right to withdraw the contract within two weeks in written form (e.g. letter, email) without stating any reasons.
The two weeks start at the day of receiving this information soonest and end after 14 days. A withdraw of the contract is in time if the customer sends a withdraw within this period of time. The declaration of withdraw has to be addressed to:

Cancellation Consequenses If the withdraw is effective both parties have to refund their benefits. The customer might have the obligation to pay a royalty for the time products have been used. The refunds have to be done within 30 days.
A withdraw is effective if the items purchased were not opened nor used.
Items that are properly packed and ready to be shipped can be sent at our risk to the following address, including the name, the customer-ID, order number and if necessary bank information for refunds:

If the items are the ones the customer purchased the shipping costs will be paid by the customer if the value of the goods is not more than Eur 40,-. Otherwise Cambree will refund you for the shipping costs.
Please do not send the package without paying the shipping costs! We will refund you once we receive the package.

§ 4 Pricing

4.1 The price of any Product will be as quoted on the Site, except in cases of errors.

4.2 These prices include VAT but exclude shipping costs. Those will be added to the total amount due once the customer has gone to the checkout.

4.3 Prices are liable to change at any time. Changes will not affect orders which Cambree received before the change of the site.

4.4 Cambree cannot complete the customer’s order until it has been paid for it in full. Payment can be made by Prepayment or Paypal. Payment information can be found in ‘Shipping and Return’.

§ 5 Payment

5.1 Payments must be made in Euro only, unless otherwise specified.

5.2 The customer can choose between paying with Paypal or prepayment (wire transfer) More information of the payment process please refer to ‘Shipping and Returen’ on the main website.

§ 6 Delivery and Shipping

6.1 Order will be shipped after Cambree received a full payment if not otherwise specified.

6.2 All orders are delivered using Hermes Logistics unless otherwise specified. The customer must request any other delivery method with the order and the products will be shipped under the customer’s responsibility. The customer has to pay for extra shipping costs if necessary.

§ 7 Passing of risk

7.1 In the event of an order being lost or damaged by a third party, Cambree bears no risk once it has left their trading premises. If products have been received damaged, a refund/exchange application will only be acknowledged if the customer states the damages in written form to Cambree within7 days.

If the customer signed for the goods received the customer bears the risk for the products. If the customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the package.
In the event of either of the above, Cambree will forward a claim to Hermes Logistics on the behalf of the customer.

§ 8 License

All rights of pictures, texts and other items on this site lay by Cambree and the partners. Usage is not allowed until given permission in written form by Cambree.

§ 9 Governing law and jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with German law. Disputes happening in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the German courts.

§ 10 Severability Clause

10.1 You may not any of your rights under these Terms & Conditions.

10.2 If any provision of these Terms & Conditions is found to be invalid by any court of jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
